Nicola Fabiano, Avvocato cassazionista, Specialista in Diritto Civile, esperto e consulente in materia di protezione dei dati personali, privacy, blockchain e sicurezza informatica, innovatore.

Nicola è ricercatore indipendente, attività che coltiva mediante pubblicazione di articoli, saggi, libri, paper, partecipando frequentemente a conferenze internazionali su data protection, privacy, blockchain, cybersecurity e IoT.

E’ certificato:

  • “Security Manager (ICT)” secondo la norma UNI 11506:2017;
  • “Professionista dei sistemi di gestione della sicurezza delle informazioni” secondo la norma ISO/IEC 27021:2017;
  • “Responsabile della protezione dei dati (RPD/DPO)” secondo la norma UNI 11697:2017;
  • “Valutatore privacy” secondo la norma UNI 11697:2017.

Nel 1994 fonda lo Studio Legale Fabiano.

Dal 2008 al 2010 è stato consulente esterno – nei campi della protezione dei dati personali e della sicurezza informatica – per alcuni progetti europei (tra cui, Safer Internet Programme Plus; Easy to Stop-it – EAST; Youth Protection Roundtable – YPRT).

Negli anni 2009-2010 ha fatto parte, per conto del nodo italiano di sensibilizzazione nell’ambito del progetto europeo “EAST2 – Easy to Stop-it”, della Task Force convocata dalla Commissione Europea ed è “contributor” del documento “Safer Social Networking Principles for the EU” presentato ufficialmente a febbraio 2009 in Lussemburgo.

Nel 2009 inizia ad approfondire il tema dell’Internet degli oggetti (Internet of Things – IoT) e il 4 dicembre 2009 a Bruxelles partecipa, con un intervento sui “legal issues” connessi alla privacy e alla sicurezza informatica, all’evento di costituzione del Council of the Internet of Things. Proseguendo l’approfondimento dell’IoT viene coinvolto come membro dell’Advisory Board del progetto europeo “Bottom Up selection, collection and management of URBAn waste – BURBA” e quale membro dell’EMG (External Member Group) del Progetto europeo BUTLER.

Nel 2010 – per le attività di ricerca in materia di protezione dei dati e Privacy by Design – viene riconosciuto dalla Dr. Ann Cavoukian, già Information & Privacy Commissioner dell’Ontario (Canada), “Privacy by Design Ambassador” e nel 2011 ha ottenuto la menzione nel documento “A Report on the State of PbD to the 33rd International Conference of Data Protection and Privacy Commissioners” presentato dalla Information and Privacy Commissioner of Ontario, Canada alla 33ma Conferenza Mondiale dei Garanti Privacy sullo stato della Privacy by Design (PbD).

Nel 2014 ha partecipato al Masterclass (Bruxelles) in Societal Security ed è iscritto nel database europeo degli esperti in Societal Security. Approfondisce l’ecosistema dell’Internet of Things con particolare riguardo alla blockchain, occupandosi delle questioni afferenti la protezione dei dati personali e la privacy.

Nel 2017 vince il corso promosso dal Consiglio d’Europa in collaborazione con il Consiglio Nazionale Forense (CNF) su “Data Protection and Privacy Rights” e viene riconosciuto “Academic Member of the Athens Institute for Education and Research, belonging to the Law Research Unit and the Computer Research Unit” dell’Athens Institute for Education and Research – ATINER.

Consulente del Governo della Repubblica di San Marino per la redazione della normativa dello Stato in materia di protezione dei dati personali.

E’ componente del comitato scientifico e docente del “Corso di alta formazione sulla protezione dei dati personali – Responsabile della protezione dei dati (DPO)” con il patrocinio del Garante per la protezione dei dati personali, organizzato dal Consiglio Nazionale Forense (CNF) e dal Consiglio Nazionale degli Ingegneri (CNI).

E’ componente del Gruppo di lavoro della FIIF (Fondazione Italiana per l’Innovazione Forense) del CNF (Consiglio Nazionale Forense);

E’ componente del “IEEE SA P7007 Ontological Standard for Ethically Driven Robotics and Automation Systems Working Group” e chair del sottogruppo “Data Privacy and Protection”;

E’ componente del Technical Committee di “The Eleventh International Conference on Evolving Internet” – INTERNET 2019, June 30, 2019 to July 4, 2019 – Rome, Italy

E’ componente del Gruppo di lavoro della FIIF (Fondazione Italiana per l’Innovazione Forense) del CNF (Consiglio Nazionale Forense) e titolare del Gruppo di Lavoro “European Transparency Register” della Delegazione italiana del CNF presso il CCBE;

E’ Referente Informatico del Consiglio dell’Ordine degli Avvocati di Foggia e presidente del Centro per l’Informatica e l’Innovazione Forense – CINFOR. È “Direttore Settore E-commerce e Consumatori Digitali” all’Istituto Italiano per la Privacy (IIP) e membro (#4228) di AIP (Associazione Informatici Professionisti).

Vincitore di numerosi Awards per Data Protection e Privacy, nonché per ICT Security e – Internet & E-Commerce (Italians Enterprise Awards 2017 – “Best Civil Law Firm 2017 & Excellence Award for Data Protection 2017” e dell’8th Annual Global Law Experts Awards 2017 nella categoria Boutique “Data Protection Law – Law Firm of the Year in Italy”).

In 1994 Nicola founded Studio Legale Fabiano (Fabiano Law Firm).

From 2008 to 2010 he was an external advisor – in the fields of personal data protection and information security – for some European projects (including, Safer Internet Program Plus, Easy to Stop-it – EAST, Youth Protection Roundtable – YPRT).

In 2009-2010 he was part, on behalf of the Italian node within the European project “EAST2 – Easy to Stop-it”, of the Task Force called by the European Commission, and he has been “contributor” to the document “Safer Social Networking Principles for the EU” officially presented in February 2009 in Luxembourg.

In 2009 he began to deepen the Internet of Things phenomenon (IoT), and on 4th December 2009, Nicola participated in Brussels to the launch-event of the Council of the Internet of Things, presenting a talk on “IoT and the legal issues”. Nicola has been involved as a member of the Advisory Board of the European project “Bottom Up selection, collection and management of URBAn waste – BURBA” and as a member of the EMG (External Member Group) of the European BUTLER project.

In 2010 – due to his research activities on Data Protection and Privacy by Design – Nicola has been recognised by Dr. Ann Cavoukian, formerly Information & Privacy Commissioner of Ontario (Canada), “Privacy by Design Ambassador” and in 2011 he has been mentioned in the document on the state of Privacy by Design (PbD) titled “A Report on the state of PbD to the 33rd International Conference of Data Protection and Privacy Commissioners”, presented by the Information and Privacy Commissioner of Ontario, Canada, at the 33th International Conference of Data Protection and Privacy Commissioners.

Nicola participated in the Masterclass on Societal Security and he is in the European Societal Security expert database.

Nicola deepens the Internet of Things ecosystem especially regarding the blockchain, dealing with issues related to data protection, privacy and Cyber Security.

In 2017 Nicola won the course promoted by the Council of Europe in collaboration with the Italian Bar Council (CNF) on “Data Protection and Privacy Rights” and recognized “Academic Member of the Athens Institute for Education and Research, Belonging to the Law Research Unit and the Computer Research Unit” of the Athens Institute for Education and Research – ATINER.

Nicola is the advisor of the Government of the Republic of San Marino for the drafting of the legislation on the protection of personal data.

Nicola is a member of the scientific committee and lecturer of the “Advanced training course on the protection of personal data – Data protection officer (DPO)”, under the patronage of the Italian Data Protection Authority (Garante), organized by the Italian Bar Council (CNF) in partnership with the National Council of Engineers (CNI).

Nicola is a member of the Working Group of the FIIF (Italian Foundation for Forensic Innovation) of the CNF (Consiglio Nazionale Forense) and member of the “European Transparency Register” Working Group of the CNF Italian Delegation at the CCBE.

Nicola is a member of the “IEEE SA P7007 Ontological Standard for Ethically Driven Robotics and Automation Systems Working Group” and Chair of the “Data Privacy and Protection” subgroup.
